1. Parties and eligibility
These Terms are a contract between Hyeonseok Oh (오현석) (“Operator”) and each user of the service. The service is available only to users aged 18 and over. You must provide an accurate birth year and keep account access credentials secure.
Google sign-in uses the email authenticated by Google as account identity. You must not impersonate another person or account. One person must not operate multiple accounts for abuse or automate around service limits.
2. Nature of AI content
Character replies are generated by artificial intelligence and may be inaccurate, offensive, or unexpected. Do not treat them as professional medical, legal, financial, or emergency advice.
The AI label in chat means a person is not manually answering. In a crisis, do not wait for Terms or email—use local emergency services or the channels listed in the Safety Policy.
3. User-created content
You retain rights in characters, settings, and messages you create. You grant the Operator a worldwide, non-exclusive operational license to store, process, display, back up, enforce safety policy, and transmit or cache content as technically needed to run the service.
Do not upload content that infringes others’ copyright, privacy, publicity, or other rights. Characters posted as public may be viewed and chatted with by other users inside the service.
4. Prohibited use
- Explicit sexual content, or content that sexualizes or exploits minors
- Creating characters that imitate or impersonate real people (celebrities, public figures, acquaintances, etc.), or using real persons’ photos, likenesses, or voices
- Non-consensual sexual acts, real-world threats of harm, self-harm encouragement, or assistance with illegal activity
- Bypassing service security, automated abuse, account trading, or operational interference
- Harvesting personal data, impersonation, spam, or malware distribution
Serious violations may lead to content blocking, account limits or termination, evidence preservation, or reports to authorities. Detailed enforcement follows the Safety Policy.
5. Paid services and payment
The base service is free and ad-supported. We may separately offer a monthly pass (ad-free chat, unlimited premium-model replies, priority replies) and an in-app credit called “Sparks” used for image generation. Sparks are a non-monetary digital item with no cash value; they are non-transferable and non-refundable once spent. Unused Sparks expire 1 year after the last grant or purchase (the expiry is extended whenever you buy or receive Sparks), and are retained after the subscription is cancelled. Configuration and prices are published on the Pricing page and announced before material changes take effect.
Monthly passes may auto-renew each billing period and can be cancelled anytime. Cancellation stops renewal at the end of the paid period. Billing, tax, receipts, and refunds follow the Merchant of Record payment partner and the Refund Policy. Card data is not stored on Operator servers.
6. Data processing location and privacy
The primary application and database are hosted in Singapore. Personal data and user content may be transferred to and processed by processors outside Singapore for login, chat storage, AI response generation, payments, and optional measurement. Collection, overseas transfers, retention, and rights are governed by the Privacy Policy, which forms part of these Terms.

7. Changes, interruptions, and liability
We may change, limit, or temporarily suspend features for safety, legal, abuse-response, or technical reasons. We try to give reasonable prior notice, but may act immediately for urgent security or legal reasons.
We do not warrant uninterrupted service against factors outside reasonable control, third-party infrastructure or model-provider failures, or the accuracy or fitness of AI output. To the extent permitted by law, we limit liability for indirect, special, or consequential damages and lost profits, and the Operator’s total liability is capped at amounts the user paid the Operator in the three months before the claim (or the minimum permitted by law for free-only use). Mandatory consumer-protection rights are not limited.
8. Termination and account deletion
You may stop using the service and request deletion anytime in account settings. The Operator may limit or terminate accounts for Terms or Safety Policy violations, long inactivity, legal duty, or service shutdown. After termination, minimum records required by law, disputes, or security may remain under the Privacy Policy.
9. Changes to Terms, governing law, and contact
When Terms change, we publish them on this page with an effective date. Material changes receive reasonable prior notice. Continued use after the effective date means acceptance of the updated Terms. If you disagree, stop using the service and request account deletion.
These Terms are governed by the laws of Singapore. Unless mandatory consumer-protection rules provide otherwise, Singapore courts have exclusive jurisdiction. Terms questions: support@kaykai.space.
